CANADIAN SPORT SCHOOL HOCKEY LEAGUE (“CSSHL”)
PRIVACY POLICY

Introduction
CSSHL is an education-based hockey league designed specifically for student athletes (“Athletes”). CSSHL features a number of sport schools and hockey teams (collectively, the “Organizations”).
Organizations may apply to enter CSSHL. More information on entering CSSHL can be found on CSSHL’s league website, http://www.csshl.ca/ (the “Website”). In order to provide the goods and/or services associated with CSSHL, CSSHL will collect, use and disclose information from and about each Organization, including without limitation personal information from and about each Athlete in each Organization. CSSHL will primarily manage such information relating to the Organizations and Athletes, via a third party platform, including without limitation, any related software, the Website, any CSSHL event and/or championship website, any other websites, the CSSHL league mobile application or any other applications, statistical and live scoring platforms, and any other service or product where CSSHL has linked to this Privacy Policy (collectively, the “Platform“).
CSSHL is committed to protecting your personal information and privacy. This Privacy Policy outlines how CSSHL collects, retains, uses, discloses, and protects your personal information in connection with its services. It governs CSSHL and any other parties (including, but not limited to, Athletes and Organizations) who may access the Platform.
In this Privacy Policy, any reference to “you” or “your” refers to both the Athlete and parent or guardian of the Athlete if the Athlete is a youth, where the context requires. Any reference to “CSSHL” includes authorized personnel of CSSHL where the circumstances so require. By providing personal information while using the Platform or otherwise dealing with CSSHL, you consent to the collection, retention, use, disclosure, destruction and protection of your personal information in accordance with the terms set out in this Privacy Policy.
Purpose
This Privacy Policy sets forth CSSHL’s policies regarding how personal information about you (your “personal information”) may be collected, retained, used, disclosed and destroyed for the purposes of CSSHL’s league, programs, services, and other offerings, and how it is protected by CSSHL. Personal information means information about an identifiable individual. This includes such things as name, age, gender, other physical attributes, address and other contact information, financial information, health information, preferences, activities and interests. Personal information does not include information that cannot be attributed to an identifiable individual, such as information of an aggregate or anonymous nature, and CSSHL is entitled to use, retain, disclose and destroy such information in its absolute discretion.
The Platform may be licensed to CSSHL by a third party technology and/or software developer (the “Third Party Developer”). The personal information is stored by the Third Party Developer on servers in Canada and the U.S., and in the cloud (stored in the U.S.). Please note that, while personal information is located outside of Canada, it is subject to the legal requirements of the jurisdiction in which it is located. The main purpose of the Platform is to provide easy-to-access and up-to-date information about the CSSHL, the Organizations, and the Athletes with the objective of delivering comprehensive services to the Organizations and the Athletes.
In order to use the Platform or other of CSSHL’s services, CSSHL may require that you provide personal information to CSSHL and consent to CSSHL collecting personal information about you from third parties. The personal information collected by CSSHL will be used to update the Platform.
Consent
When you use CSSHL’s services, you provide ongoing implied consent to the collection, retention, use, disclosure, destruction and protection of your personal information by CSSHL in accordance with the terms of this Privacy Policy.
CSSHL will obtain your express consent prior to or when collecting, using or disclosing your personal information for a purpose that is not described in this Privacy Policy, or for a purpose that CSSHL did not identify to you or that was not reasonably expected at the time of collection, unless CSSHL is required or authorized by law not to obtain your consent.
In certain circumstances, without limiting the foregoing provisions, including but not limited to when dealing with certain legal, medical, or security issues, CSSHL may be authorized or required by law to disclose your personal information without seeking or obtaining your consent.
When using the Platform and dealing with CSSHL, you may choose not to provide certain personal information. However, if you choose not to provide information that CSSHL requests, it may limit the manner in which you use the Platform and otherwise interact with CSSHL or you may not be able to access certain of the services offered by CSSHL.
In certain circumstances, CSSHL may provide you with the opportunity to opt-out of certain collections, uses and disclosures of your personal information, unless otherwise provided for in this Privacy Policy. If you fail to indicate within a reasonable time that you wish to opt out of the particular collection, use or disclosure when you are given a reasonable opportunity to do so, you implicitly consent to such collection, use or disclosure of your personal information.
In certain circumstances, CSSHL may provide you with the opportunity to opt-in to certain collections, uses and disclosures of your personal information. If you do not opt-in to a particular collection, use or disclosure of your personal information when given a reasonable opportunity to do so, you do not consent to your personal information being collected, used or disclosed in that particular manner.
Amending or Withdrawing Consent
You may amend or withdraw your consent for the collection, use, or disclosure of your personal information at any time, subject to legal or contractual restrictions. To do so, please contact CSSHL’s Privacy Officer using the contact information provided in this Privacy Policy. Any change to or withdrawal of consent will not apply retroactively. CSSHL reserves the right to continue handling your personal information in those circumstances required or permitted by law despite a change or withdrawal of consent.
Data Collection, Use and Disclosure
Except as otherwise provided in this Privacy Policy, CSSHL will obtain your consent to collect your personal information and will inform you of any intended use and disclosure of your personal information, unless such intended use and disclosure is described in the Privacy Policy or is reasonably expected when CSSHL collects your personal information.
In some instances, CSSHL may collect personal information about you directly from a third party, which you provide your ongoing consent for as part of your participation in the CSSHL, pursuant to this Privacy Policy and your signed consent forms, if any.
When CSSHL uses or discloses your personal information, it will ensure that you previously provided consent to the intended use or disclosure or it will obtain your consent prior to using or disclosing your personal information in that particular manner, unless the intended use or disclosure is described in this Privacy Policy, was identified to you or was reasonably expected when CSSHL collected your personal information, or is permitted or required by law without your consent.
By participating in CSSHL programs or using its services, you consent to the collection, use, and sharing of personal information for purposes such as service delivery, promotion, and commercial activities. This includes sharing data with authorized third-party service providers like FloSports.
You acknowledge that FloSports may collect, use, share, and sell certain data, including names, heights, weights, competition results, and other information for commercial purposes. This may involve providing or selling such data to business partners, service providers, marketing companies, and other third parties. CSSHL will ensure that data shared with third parties, including FloSports, is handled according to this Privacy Policy and applicable data protection laws.
The following are particular circumstances in which CSSHL may use or disclose your personal information without obtaining your further consent. By providing your personal information to CSSHL, you consent to the following uses or disclosures:
- using personal information for the purpose for which it was provided and certain other activities that are reasonably ancillary to that purpose;
- using your personal information to identify you and deliver the services that you request;
- using your personal information to communicate with you regarding the services that you request and to provide you with information about new features or enhancements to CSSHL’s services or the Platform;
- using your personal information to provide you with information about CSSHL;
- using payment method preferences and related financial information that you provide to CSSHL so that CSSHL can obtain payment for the services that you request;
- using your personal information to assist CSSHL in delivering its services and the Platform in accordance with your preferences, and in developing and enhancing its services or the Platform;
- using your personal information to assist CSSHL in conducting market analysis and strategic planning;
- where the disclosure is set out in the related documentation for services CSSHL provides to you, or the Platform, or is reasonably expected through the provision of CSSHL’s services, the Platform, or the operation thereof;
- where CSSHL must disclose your personal information in order to comply with any applicable legal obligation, legal or regulatory process, or an order or request of a government institution, investigative body, regulatory body or judicial authority of competent jurisdiction;
- where disclosure is necessary to enable CSSHL or its staff, employees, agents, contractors, suppliers, affiliates or partners to provide a product or service to CSSHL or to you. CSSHL will act in a reasonable manner, including by contractual or other means, to ensure that these individuals or entities collect, use and disclose your personal information only as necessary to provide the product or service, adhere to this Privacy Policy or to their own comparable privacy policy, and comply with applicable privacy legislation with respect to your personal information, but CSSHL cannot guarantee these individuals’ or entities’ compliance;
- where CSSHL transfers or considers transferring control to a third party of any or all of its assets, business, or services, including its rights and obligations relating to its services or the Platform. The third party may continue to retain and use the personal information that you provided to CSSHL. CSSHL will act in a reasonable manner, including by contractual or other means, to ensure that the third party agrees to similarly be bound by this Privacy Policy and to similarly comply with applicable privacy legislation with respect to your personal information, but CSSHL cannot guarantee the third party’s compliance;
- where CSSHL amalgamates with a third party, the amalgamated entity may continue to use and disclose your personal information. CSSHL will act in a reasonable manner, including by contractual or other means, to ensure that the amalgamated entity agrees to similarly be bound by this Privacy Policy and to similarly comply with applicable privacy legislation with respect to your personal information, but CSSHL cannot guarantee the amalgamated entity’s compliance;
- CSSHL may disclose a limited amount of personal information to third parties, including vendors (such as FloSports, Inc., which provides the CSSHL with access to its LeagueStat software and content management system), subcontractors, and third party payment processors located in Canada and the United States. Where CSSHL works with such third parties, CSSHL will act in a reasonable manner to request that these third parties collect, use and disclose your personal information only as necessary for the services these third parties provide to CSSHL, adhere to this Privacy Policy or to their own comparable privacy policy, and comply with applicable privacy legislation with respect to your personal information, but CSSHL cannot guarantee these organizations’ compliance; and
- where CSSHL believes in good faith that disclosure is necessary, including without limitation with respect to suspected or actual illegal activities, to enforce agreements to which CSSHL is a party, to investigate and defend CSSHL against any third party claims or allegations, to protect the security or integrity of CSSHL’s services or the Platform, and/or to exercise or protect the rights, property, or personal safety of CSSHL, its clients and users, employees, or others.
Opt-Out Mechanism for Data Sales
You have the right to opt-out of the sale or sharing of personal data by FloSports. To exercise this right, you must contact CSSHL’s privacy officer and submit a written request to opt-out. Opting out of data sales may impact the availability or functionality of certain services provided by FloSports or CSSHL, such as live-streaming or statistical analysis.
Accuracy, Completeness, and Corrections
CSSHL will make a reasonable effort to ensure that the personal information it collects, uses, or discloses is accurate, up-to-date, and complete. Accordingly, it may be necessary for CSSHL to request additional information from you or have you verify your personal information. Should your personal information change, please promptly inform CSSHL of the change.
On your written request, CSSHL will make every reasonable effort to correct errors or omissions in your personal information where that information is in CSSHL’s custody or control. CSSHL requires that all such requests be signed by the requestor and include sufficient detail to enable CSSHL to identify any record in the custody or under the control of CSSHL containing the requested personal information.
If you make such a request, CSSHL will, within such time as permitted or required by applicable privacy legislation:
- correct the personal information and, if reasonable to do so, send correction notifications to any third party to whom CSSHL disclosed the incorrect information; or
- decide not to correct the personal information, but CSSHL will annotate the personal information under its control to indicate that a correction was requested but not made.
CSSHL will inform you of the action that it has taken in response to your request for correction, the name of the individual who can answer your questions on behalf of CSSHL about your request for correction, and that you may ask for a review of the action taken in accordance with the relevant privacy legislation.
Notwithstanding any requests for corrections of personal information, CSSHL will not correct or otherwise alter an opinion, including a professional or expert opinion.
Retention, Security, and Destruction
CSSHL may retain your personal information while it reasonably requires your personal information for the purposes for which it was collected, for legal or business purposes, to comply with its legal obligations, to resolve disputes, and to enforce this Privacy Policy and any terms of use.
CSSHL has implemented reasonable security safeguards to keep confidential and secure your personal information against various risks (e.g. theft). These safeguards may vary depending on the circumstances (e.g. sensitivity of the personal information), and may include organizational, physical, technological, and contractual security measures (e.g. non-disclosure or confidentiality agreements). For example, CSSHL restricts who is able to access your personal information.
CSSHL will act in a reasonable manner, including by contractual or other means, to require third parties to whom CSSHL discloses your personal information in accordance with this Privacy Policy or as required or permitted by law to similarly safeguard your personal information by abiding by this Privacy Policy or their own comparable privacy policies and by complying with applicable privacy legislation with respect to your personal information. However, CSSHL cannot guarantee such compliance by third parties.
Within a reasonable period after CSSHL no longer reasonably requires your personal information, CSSHL will destroy the records under its custody or control containing your personal information or CSSHL will render your personal information anonymous so that it can no longer be used to identify you. CSSHL will retain certain of your personal information on the Platform for historical purposes (i.e. player information and statistics).
Request for Access
CSSHL requires that any request for access to personal information be in writing, signed by the requestor, with sufficient detail to enable CSSHL to identify any record in the custody or under the control of CSSHL containing the requested personal information.
On such written request, CSSHL will provide you, within such time as permitted or required by applicable privacy legislation, with a response to your request which may include without limitation access to your personal information (if any) under CSSHL’s custody or control.
If you request a copy of your personal information and the information can reasonably be reproduced, CSSHL will provide you with a copy of the record or the part of the record containing the requested information or it will inform you of any delay in providing same.
If you request to examine the record containing your personal information or if the requested record cannot reasonably be reproduced, CSSHL will permit you to examine or access the record or part of the record in accordance with this Privacy Policy.
All requests may be subject to reasonable fees and disbursements, where permitted by applicable privacy legislation. CSSHL may require advance payment of a deposit or the entire costs of responding to a request for access to personal information.
CSSHL reserves all rights not to disclose personal information, in whole or in part, in certain circumstances permitted or required by law, including but not limited to where the disclosure could reasonably be expected to threaten the safety or physical or mental health of an individual or the information is protected by any legal privilege.
If access to your personal information is refused, in whole or in part, CSSHL will provide you with the reasons for the refusal, the provision of the relevant privacy legislation on which the refusal is based, and the name of an individual who can answer your questions on behalf of CSSHL about the refusal, and will inform you that you may ask for a review of the refusal in accordance with the relevant privacy legislation.
Cookies
CSSHL’s Platform may collect the domain names, IP addresses and the activity of visitors. CSSHL may use cookies or a similar type of file (e.g. clear gifs, web beacons, tags) on the Platform. CSSHL may track your usage of the Platform, to provide you with tailored information and services on the Platform based on your previous visits, and to improve the content of the Platform. Cookies do not enable CSSHL to identify you unless you have previously provided personal information during a visit.
If your browser permits, you may adjust the settings of your Internet browser to notify you when you receive a cookie or to reject cookies altogether, but in some cases doing so may affect your ability to use the Platform.
Monitoring and Other Collection, Use and Disclosure of Personal Information
CSSHL may monitor your use of the Platform to ensure the proper use and operation of the Platform and your compliance with any agreements and terms of use for the Platform.
CSSHL also reserves the right to collect, use and disclose your personal information without your consent where permitted or required by law.
Amendment
CSSHL may amend this Privacy Policy at any time. Amendments may include, without limitation, additions, deletions or modifications to this Privacy Policy. The amended Privacy Policy is effective when posted on the Platform.
Your continued use of the Platform following an amendment to the Privacy Policy means that you accept the terms of the Privacy Policy, as amended. If you do not agree with any of the terms or conditions in the amended Privacy Policy, then your sole recourse and remedy is to cease all use of the Platform.
